Terms of Service

Rules for using DataLaunch, including trials, billing, tracking modes, and your responsibilities as a site owner.
Agreement
These Terms of Service ("Terms") govern your access to and use of DataLaunch at datalaunch.io and related services (the "Service"). By creating an account, installing our tracking script, or using the dashboard, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
The Service
DataLaunch provides privacy-oriented website analytics: realtime and historical metrics, traffic sources, goals, funnels, optional revenue integrations, team access per site, and related features as described on our website and in your plan. Features may change over time; we may add, modify, or discontinue functionality with reasonable notice where practicable.
Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. One person or legal entity may not share credentials in a way that violates plan limits (e.g. team seats). We may suspend or terminate accounts that violate these Terms or pose security or abuse risk.
Free trial, plans & billing
We may offer a 7-day free trial without requiring a credit card. The trial begins when your site receives its first tracked event, subject to product rules in the dashboard. Trial usage may be capped (currently 50,000 events). After the trial, you must subscribe to a paid plan to continue full access. If you do not upgrade, a grace period (currently 8 days) may apply before analytics data is purged. Paid subscriptions renew according to the billing interval you select until cancelled. Fees are processed by our payment provider; taxes may apply. Refund policy follows what we publish at checkout or as required by law.
Your sites & tracking script
You may only add domains you own or have permission to track. You choose a tracking mode per site: • Cookieless — track.cookieless.js (session-only browser storage, daily server pseudonym) • Standard — track.js (persistent localStorage visitor ID for journeys and returning visitors) Neither analytics mode uses HTTP cookies. You must install the script matching your selected mode. You are responsible for your own privacy policy, cookie/consent notices (where applicable), and lawful basis for analytics on your site. DataLaunch is not legal advice.
Acceptable use
You agree not to: (a) track sites without authorization; (b) attempt to identify individual visitors beyond what the product provides; (c) reverse engineer, scrape, or overload the Service; (d) upload malware or interfere with other users; (e) use the Service for unlawful surveillance or discrimination; (f) resell the Service without written permission. We may rate-limit ingest endpoints to protect platform stability.
Intellectual property
DataLaunch owns the Service, software, branding, and documentation. You retain ownership of your website content and analytics data generated from your sites. You grant us a limited license to host, process, and display your data solely to provide the Service.
Availability & disclaimers
The Service is provided "as is" and "as available." We strive for high uptime but do not guarantee uninterrupted or error-free operation. Analytics may be incomplete when visitors block scripts, use privacy tools, or when network issues occur—especially in cookieless mode for long-range attribution. Dashboard figures are informational, not financial or legal advice.
Limitation of liability
To the maximum extent permitted by law, DataLaunch and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve (12) months before the claim, or one hundred US dollars (USD $100) if you have not paid fees, whichever is greater. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
Indemnification
You will defend and indemnify DataLaunch against claims arising from your websites, your use of the tracking script, your violation of these Terms, or your violation of applicable law (including privacy and marketing laws), except to the extent caused by our gross negligence or willful misconduct.
Termination
You may stop using the Service and delete sites at any time. We may suspend or terminate access for breach, non-payment, or to protect the platform. Upon termination, your right to use the Service ends. Data handling after termination follows our Privacy Policy and retention rules.
Governing law & disputes
These Terms are governed by the laws applicable to DataLaunch's place of operation, without regard to conflict-of-law principles. Disputes should first be raised with hello@datalaunch.io. Where permitted, disputes will be resolved in the courts of that jurisdiction.
Changes & contact
We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance. Questions: hello@datalaunch.io.
